2. Service Description

MortgagePro Sites provides professional mortgage website templates, custom setup, and ongoing hosting and maintenance services. Our services include:

• Professional mortgage website template selection and customization
• Complete website setup and launch (typically within 3 business days)
• Ongoing hosting and maintenance services
• Technical support for website functionality

3. Managed Plan Pricing and Payment Terms

3.1 Setup Fee

A one-time setup fee of **$499** is required to begin service. This fee covers template customization, branding, content setup, and initial website launch.

3.2 Monthly Hosting and Maintenance

A monthly hosting and maintenance fee of **$69** is due on the same date each month following the initial setup. This fee covers:

• Website hosting and server maintenance
• Security updates and backups
• Limited technical support (see Section 6 for details)
• Platform maintenance and third-party service costs
• WordPress core and plugin updates
• Basic uptime monitoring

3.3 Payment Due Dates

Monthly payments are due on the anniversary date of your service activation. Late payments may result in service suspension or termination.

4. Refund and Cancellation Policy

4.1 Seven-Day Satisfaction Guarantee

We offer a 7-day satisfaction guarantee from the date of website delivery. If you are not satisfied with your website within this period, we will work with you to address concerns or provide a partial refund minus setup costs and any third-party expenses incurred.

4.2 No Refunds After 7 Days

No refunds will be provided after the 7-day guarantee period. This policy exists because:

• The client owns the completed website and domain
• Significant custom work and branding has been completed
• Third-party services and licenses have been activated

4.3 Service Cancellation

Clients may cancel hosting and maintenance services at any time with 30-day written notice. Upon cancellation, the client retains ownership of their website and domain but will be responsible for their own hosting and maintenance.

5. Website Ownership and Migration

5.1 Client Ownership

Upon completion of setup and payment of the setup fee, the client owns their customized website and domain. Best Suited Business Solutions retains rights to the base template designs.

5.2 Migration Services

Should the client choose to migrate their website to another hosting provider, a migration fee applies. This fee is calculated to ensure the total amount paid by the client for the “Launch Plan” (setup + managed plan payments) does not exceed **$1497**. The maximum total amount of **$1497** includes the one-time **$499** setup fee.

The migration fee is calculated as follows:

$1497 – (total monthly payments made + **$499** setup fee) = **Prorated Migration Fee**

This fee covers the website backup and export, technical assistance with migration, and documentation of the current setup.

Example:

• If a client has been on the managed plan for 5 months:
• Total Monthly Payments: 5 months x $69/month = $345
• Total Paid (so far): $345 (monthly payments) + $499 (setup fee) = $844
• Migration Fee: $1497 – $844 = **$653**

In this example, the client would pay a **$653** migration fee to move their website to another hosting provider.

6. Support Services and Limitations

6.1 Included Support (Covered by Monthly $69 Fee)

Our monthly hosting fee includes **limited technical support** for the following:

• Website downtime or hosting-related issues
• Broken links or missing images caused by server issues
• WordPress security updates and core functionality
• Plugin conflicts affecting basic website operation
• Basic password resets and user access issues
• Simple content updates (text changes, contact information)
• Form submission issues or email delivery problems
• SSL certificate and security maintenance
• **30 minutes per month of updates or changes to site design or copywriting**

6.2 Additional Work (Subject to Extra Fees)

Any work beyond the scope of the original template setup is subject to additional fees. This includes but is not limited to:

• Design changes or layout modifications
• Adding new pages, sections, or functionality
• Custom content creation or copywriting (beyond the 30-minute monthly limit)
• New photo editing or graphic design work
• Integration with new third-party services
• Training on website management
• Marketing consultation or SEO optimization
• Custom development or coding work
• Data migration from other platforms
• Extensive troubleshooting of client-caused issues

6.3 Support Response Time

We aim to respond to support requests within 1-2 business days. Critical hosting issues affecting website availability will be prioritized.

6.4 Client-Caused Issues

Issues resulting from client modifications, third-party integrations, or improper use of the website may be subject to additional diagnostic and repair fees.

7. Platform and Technical Details

7.1 WordPress Platform

All websites are built on the WordPress platform. Clients who choose to self-host will be subject to WordPress’s terms of service and any associated costs.

7.2 Third-Party Plugins and Services

Websites may utilize premium plugins and third-party services to provide enhanced functionality. If clients migrate away from our hosting:

• Pro features of certain plugins may require separate licensing
• Third-party service integrations may require separate accounts
• Some functionality may be affected without proper licensing

7.3 Service Dependencies

Our **$69** monthly fee covers various platform costs, third-party service fees, and premium plugin licenses. Clients who discontinue our hosting services will be responsible for securing their own licenses and services to maintain full website functionality.

8. Limitation of Liability

Best Suited Resources, LLC’s liability is limited to the amount paid for services in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages including but not limited to loss of profits, data, or business opportunities.

9. Intellectual Property

9.1 Template Rights

Best Suited Business Solutions retains ownership and rights to base template designs, code, and proprietary systems.

9.2 Client Content

Clients retain ownership of their content, branding materials, and customized website once setup is complete and paid for.

10. Service Level Expectations

10.1 Setup Timeline

Website setup typically takes 3 business days from receipt of all required materials from the client. Delays in providing necessary content, branding materials, or approvals may extend this timeline.

10.2 Uptime

While we strive for maximum uptime, we do not guarantee 100% uptime due to factors beyond our control including server maintenance, updates, and third-party service dependencies.

11. Client Responsibilities

Clients are responsible for:

• Providing accurate and complete information for website setup
• Timely payment of all fees
• Compliance with all applicable laws and regulations
• Appropriate use of the website and services
• Maintaining backup copies of important content

12. Termination

We reserve the right to terminate services immediately for:

• Non-payment of fees
• Violation of these terms
• Illegal or inappropriate use of services
• Abusive behavior toward staff

13. Governing Law

These terms are governed by the laws of the State of Texas. Any disputes will be resolved in the courts of Dallas County, Texas.

14. Changes to Terms

We reserve the right to modify these terms at any time. Clients will be notified of significant changes via email. Continued use of services after notification constitutes acceptance of new terms.
